Information We Collect Through Automated Means

We may collect, receive, and store certain information in connection with actions you take on thePlatform and in connection with use of the Platform (“Device and Usage Data”).As discussed further below in the “Cookies & Similar Technologies” section, we and our service providers may use a variety of technologies, including cookies, to assist in this information collection. These tools may collect the type of operating system or browser you use, the type of device you use, your IP address, internet service provider, unique device identifiers, and other information in accordance with your device settings and permissions. We may also collect the pages you view, referring and exit pages, the date and time of your visit, the number of clicks to, from, and within the Platform, time spent on each page, usage preferences, and search terms.

We may also collect different types of information about your location, including general location information (such as your IP address and the state or territory of your primary betting location) and more specific information (such as GPS-based functionality on your devices used to access the Platform), and we may use that information to customize the Platform with location-based information, advertising, and features.

Information We Collect From Other Sources

We may collect information from other sources, such as sportsbook and fantasy sports operators, social networking services, sweepstakes, contests, and public records. When you use features to connect accounts from third-party sportsbook and fantasy sports operators, we may collect your userID and username associated with that third-party operator, as well as other information related to your account, such as live bets, betting history, lineups and rosters, identities, notifications, settings, and preferences. If you choose to log in, access or otherwise connect to Bettor Vision, or contact Bettor Vision, through a social networking service, we may collect your user ID and username associated with that social networking service, as well as any information you make public using that social networking service. We may also collect information you have authorized the social networking service to share with us (such as your userID, public profile information, email address, birthday, friends list, and pages you have “liked”). We may also obtain contact and business information used to communicate with you about the Platform from sweepstakes, contests, and public records.

We may also work with a number of companies that assist in marketing our services to you on third-party websites, mobile apps, and online services. These third parties may use cookies, web beacons, or other tracking technologies to collect information about your use of the Platform and your activities across other websites and online services, which they may associate with persistent identifiers.Sometimes, these identifiers may be derived from a hashed or encrypted version of personal information such as your email address. We may use this information to measure the performance of our advertising as well, for instance, to evaluate which ads or content our users prefer, or which are most effective. In addition, sometimes we or an advertising partner may tailor advertising to you across different devices.

Your Choices to Manage Information

Email Communications

You can use the unsubscribe link found at the bottom of emails we send you to opt out of receiving future marketing emails. Note that you will continue to receive transaction-related emails regarding products or services you have requested or engaged with. We may also send you certain non-promotional communications regarding us and our Platform, and you will not be able to opt out of those communications using the unsubscribe link (e.g., communications regarding the Platform or updates to our Terms or this Privacy Policy).

Push Notifications and In-App Notifications

We may send you push notifications through our App. You may opt out from receiving these notifications by changing the settings on your mobile device. We may send you in-App notifications, which you may be able to opt out of through your account settings.

"Do Not Track"

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Because of the changing state of technology and indecision within the industry regarding the meaning of DNT signals, we currently do not make any guarantee that we will honor DNT signals. Tailored Advertising

We may use the information we collect in connection with the Platform to tailor the advertising you see. You have choices about how information about you is used to tailor the ads you see online.

Modifying your mobile device or browser settings may have different results depending on the type of device or web browser you use and the version of your device’s operating system. Opting out of tailored advertising does not prevent you from seeing ads online; instead, the ads you see are less likely to be customized to your interests. Opting out is generally effective only on a device-by-device, or browser-by-browser basis. If you use more than one browser or device, the effect of any opt-out mechanism may be limited to the device or browser on which you used the mechanism.

Security of Your Information

We recognize the importance of implementing a variety of security safeguards designed to protect the confidentiality of your information. However, no data transmission over the internet or other network is completely secure. As a result, while we strive to protect information you transmitted on or through our Platform, you do so at your own risk.

When you create an account, you may be prompted to create a username and password. If you create an account with us, you are responsible for maintaining the confidentiality of your account password and for any activity that occurs under your account. We are not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password. We urge you to change your passwords often, use a combination of letters and numbers, and make sure you are using a secure connection. If you have reason to believe that your interaction with us is no longer secure or if you suspect someone else is using your account, please let us know immediately by contacting us as indicated in the “Contact Us” section below.

How Long We Retain Your Data

We will retain your information for as long as we have a business need for it or as needed to comply with applicable legal obligations. We also retain and use your information as necessary to resolve disputes, protect Bettor Vision and our users, and enforce our agreements.

"Shine The Light" Disclosure

California’s “Shine the Light” law(Cal. Civil Code section 1798.83) gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined by applicable California law) with third parties for their direct marketing purposes, or to permit such residents to “opt out” of such sharing. We do not share your personal information with third parties for their own direct marketing purposes.

Children's Privacy

OurPlatform is not directed to or intended for use by children, and we do not knowingly collect or otherwise process personal information from children under the age of 16. If we learn that a child under the age of 16 has opened an account or otherwise provided us with personal information, we will promptly take steps to delete such information and terminate the child’s account.
